Indiana Military Family Leave


In accordance with Indiana's Military Family Leave Act, the Company provides unpaid leave to eligible family members of individuals on active duty in the United States Armed Forces or the Indiana Army or Air National Guard.  "Active duty” means full-time service on active duty orders for a period of at least 90 consecutive calendar days.  


To be eligible for Military Family Leave, an employee must have been employed by the Company for at least 12 months and must have worked at least 1,500 hours during the 12-month period immediately preceding the date that the leave is to begin.  Furthermore, the employee must be a relative of any one or more of the following individuals on active duty: spouse; parent (biological, adoptive, foster, or step); court-appointed guardian or custodian; grandparent (biological, adoptive, foster, or step); sibling (biological, adoptive, foster, or step); child (biological, adopted, foster, or step). 


Eligible employees may take up to 10 days off work per year as Military Family Leave.  Under this policy, a year is a "rolling" 12-month period measured backward for each employee from the date he/she uses Military Family Leave.  Leave can be taken during: the 30 days before active duty orders are in effect; during a leave provided to the one on active duty while the active duty orders are in effect; and the 30 days after the termination of the active duty orders.  Any such leave granted under the Indiana Military Family Leave Act that also qualifies for leave under the FMLA shall be counted as days off under both leaves simultaneously.


Employees must provide a written request for Military Family Leave to the Supervisor or designated management official and provide a copy of active duty orders, if available, before taking leave.  This request must be made at least 30 days before the date the requested leave is to begin unless the active duty orders are issued fewer than 30 days prior to the date the requested leave is to begin.  Employees may choose to use accrued and available PTO to remain in pay status during a leave under this policy. Requests to use accrued paid leave during this leave must be included in the employee’s request for leave.  PTO cannot be used to extend any employee’s approved Indiana Family Military leave time.

Upon return from Indiana military family Leave, employees will generally be restored to their position if the employees’ assignments are still active and available.  No retaliatory action will be taken against an employee because of the use of Military Family Leave.  If, during the leave, a layoff or other event occurs that would have changed, or even eliminated, the employee's job had he or she not taken leave, the employee will have no greater rights than if he or she had been continuously employed during the leave.
